MGA DAPAT MALAMAN NG MGA MAMAMAYAN NG MARINDUQUE

Ang naganap sa Barangay Lupac, Boac, noong ika-11 ng Oktubre (1985) ay isang pangyayaring ni sa panaginip ay hindi dapat naganap sa ating hugis-pusong lalawigan.

Ayon sa mga ulat ay may naganap na nakawan sa malaking bahay na bato sa Lupac na pag-aari ni Delegada Carmencita O. Reyes...

Ang hinaing ng mamamayan ng Barangay Lupac ay ito:

1.       Alas 12:00 ng gabi, Biernes matapos malaman na may naganap na nakawan ay limang bahay ang pinasok at hinalughog ni Maxi Pena – panauhin sa malaking bahay, ng wala namang dalang “search warrant” o ni kasamang isa mang authoridad.

2.       Bago maganap ang paghahalughog, si Nolan Lanete, isang 14 na taong gulang ay tatlong ulit na inilublob sa dagat ni Maxi Pena at hinayaang naroon sa tabing dagat ng may isang oras sa lamig ng gabi (kasamang sipi).

3.       Linggo ng umaga, ang isa sa mga katulong sa malaking bahay na si Pecifico Hilario ay sinuntok, tinadyakan, pinalo ng puluhan ng baril sa kaliwang balikat at hindi pa nasiyahan ay iinilad mula 10:00 ng umaga hanggang alas 3:00 ng hapon sa arawan sa tabi ng aplaya.

4.       Si Elvira  Monteras, isang pinagkakatiwalaan ni Delegada Carmencita O. Reyes nang mahigit na 15 taon na ngayon ay tatlong ulit na sinampal at tinadyakan sa panga ng nasabi rin na si Maxi Pena.

5.       Si Reynaldo Mabato, isang suspect na taga Mainit, ay hinuli sa pamilihang bayan at nang ayaw sumama ay kinarati at sinakal ng isang nagngangalang Ninoy Mascarenas.

6.       Hanggang sa kasalukuyan, ang mga nabanggit na mga katulong sa malaking bahay at iba pang hindi nabanggit ay nakakulong pa sa komandansya simula pa noong Linggo na sa sandaling ito ay may apat na araw na o 96 oras na ngayon.

MANILA, Philippines - Three former ranking government officials accused of involvement in the so-called fertilizer fund scam of 2004 posted bail in different amounts at the Sandiganbayan yesterday.
Former Catanduanes governor Leonardo Verceles Jr., who is facing one graft case, paid P30,000 in exchange for his temporary liberty.

Former lawmakers Nanette Castelo-Daza of Quezon City and Carmencita Reyes of Marinduque, on the other hand, posted bail in the amount of P60,000 each since they are also facing technical malversation charges apart from alleged violation of the Anti-Graft and Corrupt Practices Act.

They were the first of many respondents to show up at the anti-graft court after the cases against them were raffled off to different Sandiganbayan divisions on Friday. Verceles, Reyes and Daza were among those who were identified as supposed beneficiaries of missing fertilizer funds.

The Office of the Ombudsman ordered the filing of charges against them last month after years of conducting an investigation into the alleged anomaly involving P728 million in public funds. The anti-graft agency also ordered the filing of plunder charges against former agriculture secretary Luis Lorenzo and former undersecretary Jocelyn “Jocjoc” Bolante.

However, the Office of the Special Prosecutor (OSP), the prosecutorial arm of the Office of the Ombudsman, has decided not to file the cases yet because both respondents filed motions for reconsideration of the resolution that found probable cause to indict them in court.

Deputy Special Prosecutor Jesus Micael said Reyes and Daza’s graft and technical malversation cases went to the Sandiganbayan First and Third Divisions, respectively, while the graft case against Verceles also went to the First Division.

He said all three posted bail even though the anti-graft court is yet to issue warrants for their arrest.
Micael has not scheduled arraignment dates.

In its Resolution, the Office of the Ombudsman said P56.64 million of the P728 million in fertilizer funds transferred to the regional field units remain unaccounted for, which is “proof of diversion, misappropriation, misuse, or malversation of public funds

Lawmakers face graft raps before Sandiganbayan

A TOTAL of 25 counts of graft, malversation and illegal use of public funds have been filed before the Sandiganbayan over the alleged P728-million fertilizer fund scam against four lawmakers and a number of regional executive directors of the Agriculture department.

Informations transmitted by the Office of the Ombudsman to the anti-graft court showed that former Representatives Oscar Gozos (Fourth District of Batangas), Federico Sandoval (Lone District of Navotas City in Metro Manila), Nanette Daza (Fourth District of Quezon City) and Carmencita Reyes (Lone District of Marinduque) were slapped with charges of violations of the Anti-Graft and Corrupt Practices Act and illegal use of public funds (technical malversation).

The Office of the Ombudsman charged each lawmaker for allegedly receiving cash that was part of the P728-million fertilizer fund allocation under the Ginintuang Masaganang Ani of then-President and now Rep. Gloria Arroyo of the Second District of Pampanga.

Reyes allegedly received P5 million and the three other lawmakers, P3 million each, which all of them used, as purchase orders showed, to buy agricultural equipment such as wood shredders and chippers.
The money was allegedly disbursed from the Agriculture department to regional executive directors who handed the cash to the lawmakers.

The cash was reportedly used to fund the campaign kitty of Mrs. Arroyo when she ran for president in the 2004 elections, which she eventually won.

The Ombudsman found out that former Agriculture Undersecretary Joceyln “Joc-Joc” Bolante orchestrated the disbursement of the fertilizer fund with the approval of then-Agriculture Secretary Luis Ramon “Cito” Lorenzo.

The regional directors of the Agriculture department who were also charged with graft and malversation were Sumail Sekak (Cotabato City), Leo Cañeda (Tacloban City), Dennis Araullo (Quezon City), Oscar Parawan (Zamboanga City), Cesar Rodriguez (San Fernando City), Roger Chio (Davao City), Eduardo Lecciones (Tagbilaran City Unit 7) and Ricardo Oblena (Tagbilaran City Unit 6).

During an earlier interview, acting Ombudsman Orlando Casimiro said that the filing of the charges before the Sandiganbayan took time because of the fact-checking process that the Office of the Special Prosecutor (OSP) undertook.

The Office of the Ombudsman affirmed the filing of the charges on April 15. But only on May 6 did the OSP transmit the charges to the Sandiganbayan. At press time, only the graft and malversation charges against the four lawmakers and the regional executive directors of the Agriculture department were sent to the anti-graft court.

The Office of the Ombudsman (OmB) will summon former Agriculture Secretary Luis Lorenzo and involved personalities in the alleged fertilizer scam to shed light in its on-going inquiry.

The development came after the OmB’s Field Investigation Office (FIO) filed on Friday a Supplemental Complaint Affidavit, which included Lorenzo as among those who should be subpoenaed.

The affidavit named respondents in the case as Lorenzo and former Agriculture undersecretary Jocelyn “Joc-joc’ Bolante for violation of Article 217 of the RPC (Malversation of Public Funds of Property) and Sec. 3 (e) of RA 3019 (Anti-Graft and Corrupt Practices Act); and Belinda and Emma Gonzales for violation of article 220 of the RPC (Technical Malversation) and Sec. 3 (e) and (g) of RA 3019.

Bolante was also charged for Violation of Art 171 of the RPC (Falsification by Public Officer) and violation of Sec. 3 (b) of RA 3019

In an earlier complaint filed by the Task Force Abono of the OMB-FIO, the following were charged with Technical Malversation, Violation of Sec. 3(e) and (g) of RA 3019, and for Dishonesty, Grave Misconduct and Conduct Prejudicial to the Best Interest of the Service under Section 46, Chapter 7, Title I, Book V of Executive Order No. 292 (Administrative Code of 1987): Carmencita Reyes, Araullo, Balagtas Torres, Juvylee Obice, Rodolfo Guieb, Mari Paz Jazmine Cabucol, Raymundo Braganza, Abelardo Bragas, Felix Ramos, Ofelia Montilla and Gregorio Sangalang.

The taskforce conducting a fact-finding investigation into the Fertilizer Fund Scam is still trying to identify other personalities involved in the anomaly, it was learned.

MANILA, Philippines - The Office of the Ombudsman has filed a complaint against public officials allegedly involved in the multimillion-peso fertilizer fund scandal.

The agency’s Task Force Abono (fertilizer) charged Quezon City Rep. Nanette C. Daza (4th district), Marinduque Rep. Carmencita O. Reyes, former Malabon-Navotas Rep. Federico S. Sandoval II and former Batangas Rep. Oscar L. Gozos for illegal fund use.

In a press conference, Assistant Ombudsman Jose T. de Jesus, Jr. said the fact-finding committee found sufficient evidence that of the P728-million budget for farm inputs/implements program, P14 million was spent for farm implements not included in the Ginintuang Masaganang Ani rice program.

In addition, the Commission on Audit (CoA) found out cheaper items that were then available from other suppliers. Mr. de Jesus said this constitutes technical malversation.

The purchases did not undergo bidding under the Government Procurement Reform Act, which, Mr. de Jesus said, constitutes technical malversation.

Other respondents were Agriculture officials Dennis B. Araullo, Balagtas J. Torres, Juvylee C. Obice, Rodolfo M. Guieb, Marie Paz Jasmine C. Cabucol, Raymundo E. Braganza, Abelardo Bragas, Felix Ramos, Ofelia Montilla and Gregorio Sangalang.

Private respondents included officials from the LCV Design and Fabrication Corp., namely, Linus C. Villanueva, Remus C. Villanueva, Phydias B. Bañez, Fernando F. Gallarte and Frederico B. Quevedo.

Similar complaints have been served for former Agriculture Undersecretary Jocelyn "Joc-Joc" I. Bolante, former Agriculture secretary Luis P. Lorenzo and incumbent Agriculture Secretary Arthur C. Yap.

The investigation stemmed from allegations that Mr. Bolante diverted funds for the Agriculture department’s rice program to allies of President Gloria Macapagal-Arroyo to ensure her election in 2004 presidential elections.

House probe

Meanwhile, the House committee on agriculture issued invitations to Mr. Bolante, Budget Secretary Rolando G. Andaya, former Budget secretary Emilia T. Boncodin, Kilusang Magbubukid ng Pilipinas Secretary-General Danilo Ramos, CoA Chairman Reynaldo A. Villar and Agriculture Undersecretary for finance Belinda A. Gonzales to attend Wednesday’s hearing on the fertilizer fund case.
